SKILL TRACER - END USER LICENSE AGREEMENT & TERMS OF USE

1.ACCEPTANCE OF THESE TERMS
1.1 These End User License Agreement and Terms of Use ("Terms") are a binding agreement between you ("you" or "User") and Metano Inc., a Delaware corporation with a principal place of business at 1051 Craig Dr, San Jose, CA 95129, USA ("Metano," "we," "us"). They govern your access to and use of Skill Tracer, the AI-skill scanning service available at https://labs.metano.ai/scanner and related interfaces and APIs (the "Service").
1.2 By checking the acceptance box, clicking to accept, accessing or using the Service, or submitting any content to it, you agree to these Terms. If you do not agree, do not use the Service.
1.3 If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes that organization.
1.4 The public Service is provided free of charge and for informational purposes only.
2.DEFINITIONS
- "Skill" or "Content": any AI agent skill, plugin, tool manifest, package, file, URL, or other material you submit to the Service for analysis.
- "Results": the analysis, reports, verdicts, scores, metadata, and derived data the Service generates from Content.
- "Public Submission": Content submitted to the free public Service, which, together with its Results, is shared publicly as described in Section 4.
- "Private Service": the separate, non-public offering described in Section 13, governed by a separate written agreement.
- "Community": all users of and visitors to the Service.
3.DESCRIPTION OF THE SERVICE
3.1 Skill Tracer lets anyone upload AI skills and related content and receive automated analysis intended to surface security, safety, provenance, and risk signals. It combines static analysis with dynamic detonation in an isolated sandbox and maps findings to public frameworks. It is conceptually similar to public malware and file-scanning services.
3.2 The Service works through the collective aggregation and public sharing of analysis with and through the Community. Public sharing is a core design principle of the Service, not an incidental feature.
3.3 Metano may change, suspend, or discontinue any part of the Service at any time.
4.PUBLIC BY DESIGN: COMMUNITY SHARING
4.1 When you make a Public Submission, the Content and its Results are immediately shared with, made visible to, and made available for download by the Community and any third party, including via a public URL. Public Submissions are not confidential.
4.2 YOU AGREE THAT YOU WILL ONLY UPLOAD CONTENT THAT YOU WISH TO SHARE PUBLICLY. YOU WILL NOT KNOWINGLY SUBMIT ANY CONTENT TO THE PUBLIC SERVICE THAT CONTAINS CONFIDENTIAL, COMMERCIALLY SENSITIVE, OR PERSONAL DATA.
4.3 IF YOU DO NOT WANT CONTENT TO BE PUBLICLY SHARED IN THE MANNER DESCRIBED IN THESE TERMS, DO NOT SUBMIT IT TO THE PUBLIC SERVICE. For non-public analysis, use the Private Service (Section 13).
4.4 Because Public Submissions are public, other users and third parties may view, download, analyze, retain, and reuse your Content and Results. Metano cannot recall, delete from third parties, or guarantee removal of Content or Results once shared.
4.5 Content such as executables, packages, and documents may contain metadata that includes personal information relating to you or others. You are responsible for what your Content contains.
4.6 Metano currently shares Public Submissions and Results publicly and does not operate a separate partner-distribution tier. Metano may in the future share submissions with vetted security partners to enrich community threat intelligence; if it does, it will update these Terms accordingly.
5.LICENSE YOU GRANT
5.1 For each Public Submission, you grant Metano and its service providers a worldwide, royalty-free, irrevocable, perpetual, transferable, and sublicensable license to use, host, store, reproduce, modify, create derivative works from, communicate, publish, publicly perform, publicly display, and distribute the Content and Results, for the purpose of operating, providing, improving, and promoting the Service and the security community.
5.2 This license reflects the public, community-sharing nature of the Service. It does not transfer your ownership of Content you own, but it does permit the public uses described in these Terms.
6.YOUR REPRESENTATIONS AND WARRANTIES
6.1 You represent and warrant that you are the owner of, or have all necessary rights, permissions, and consents to, the Content you submit and to grant the license in Section 5, including rights and consents for any personal information contained in the Content.
6.2 You represent that your Content and your use of the Service do not and will not violate any law, regulation, or third-party right, and that you will not upload confidential, trade-secret, export-controlled, or personal data to the public Service.
6.3 You are solely responsible for the legality of your Content and for any third-party claims arising from disclosure of information contained in your Public Submissions.
7.NO USE OF UPLOADS FOR MODEL TRAINING
7.1 Metano does not use Content you upload to train, fine-tune, or otherwise develop machine-learning or AI models.
7.2 For clarity, this does not limit the public sharing of Public Submissions and Results with the Community and third parties as described in Section 4, or Metano's use of Content and Results to operate, provide, secure, and improve the Service (for example, generating and displaying Results and threat intelligence).
7.3 Because Public Submissions are public, third parties who access them are outside Metano's control. Metano makes no representation about, and is not responsible for, how such third parties use Content or Results, including any use to train models.
8.ACCEPTABLE USE / PROHIBITED CONDUCT
You will not:
8.1 Use the Service in violation of any applicable law or regulation, or to infringe Metano's, the Community's, or any third party's rights.
8.2 Upload content that is unlawful, infringing, defamatory, or that you lack the rights to share, or that contains another party's confidential, personal, or export-controlled data.
8.3 Develop or test evasive skills, payloads, or techniques designed to bypass, defeat, or degrade the detection capabilities of the Service.
8.4 Use the Service, its Content, or its Results to build, train, or improve a competing scanning product, or misrepresent Results as endorsed or certified by Metano. (For clarity, sharing and referencing Results in the public interest for security purposes is permitted, provided you do not misrepresent them.)
8.5 Mine, harvest, or re-identify personal information from Content, Results, or the public corpus.
8.6 Damage, overload, disrupt, or attempt unauthorized access to the Service or its infrastructure, including denial-of-service activity or automated scraping outside a permitted API.
8.7 Submit material regulated under export-control or arms-trafficking laws (for example, ITAR/EAR-controlled materials).
8.8 Misrepresent your identity or exceed published rate limits or quotas.
8.9 Metano may refuse, remove, rate-limit, suspend, or block access (including by IP) at any time, with or without notice, where it perceives a threat to the Service or a breach of these Terms.
9.INTELLECTUAL PROPERTY
9.1 As between you and Metano, Metano owns the Service and all Results, reports, scores, and derived intelligence it generates, excluding the underlying Content you own.
9.2 Metano owns all rights in any portion of the Service or Results produced by its own systems, including AI systems.
9.3 Metano publishes Results in the public interest and encourages their sharing. You may share and reference Results provided you do not misrepresent them or remove attribution to Skill Tracer / Metano.
9.4 Any feedback you provide about the Service may be used by Metano without restriction or obligation to you.
10.DISCLAIMERS
10.1 THE SERVICE, CONTENT, AND RESULTS ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
10.2 METANO DOES NOT WARRANT THAT THE SERVICE IS FREE OF ERRORS OR DEFECTS, OR THAT IT WILL DETECT, REPORT, OR CORRECTLY DETECT OR REPORT ANY THREAT, VULNERABILITY, OR RISK IN ANY CONTENT. YOU WILL USE YOUR OWN INDEPENDENT JUDGMENT AND WILL NOT RELY ON THE RESULTS FOR ANY PURPOSE.
10.3 CONTENT SUBMITTED TO THE SERVICE MAY BE OR CONTAIN MALICIOUS CODE. METANO IS NOT RESPONSIBLE FOR CONTENT UPLOADED BY USERS OR FOR ANY HARM, INFECTION, OR DAMAGE RESULTING FROM ACCESSING, DOWNLOADING, OR HANDLING SUCH CONTENT. YOU HANDLE SAMPLES AT YOUR OWN RISK.
11.LIMITATION OF LIABILITY
11.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, METANO AND ITS AFFILIATES, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER THEORY, ARISING FROM OR RELATED TO THE SERVICE, CONTENT, OR RESULTS.
11.2 METANO IS NOT LIABLE IN CONNECTION WITH ANY CONTENT UPLOADED BY USERS, INCLUDING ANY LEGAL CONSEQUENCES OF SUCH CONTENT.
11.3 The public Service is provided free of charge; the disclaimers and exclusions above are a material basis of Metano offering it.
12.INDEMNIFICATION
12.1 You will defend, indemnify, and hold harmless Metano, its affiliates, and their personnel from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your Content; (b) your use of the Service; (c) your breach of these Terms; or (d) your violation of any law or third-party right, including privacy, IP, or confidentiality rights.
13.PRIVATE / ENTERPRISE VERSION
13.1 A private, non-public version of Skill Tracer is available for customers who do not want their submissions shared publicly. The Private Service is governed by a separate written agreement and is not covered by these public Terms.
13.2 Confidentiality, data-handling, and commercial terms for the Private Service are set out in that separate agreement. To request the Private Service, contact info@metano.ai.
14.SUSPENSION, TERMINATION, AND CHANGES
14.1 Metano may suspend or terminate your access at any time, including for breach of these Terms.
14.2 Metano may modify these Terms from time to time. Changes are effective when posted or as otherwise stated. Your continued use after changes take effect constitutes acceptance.
14.3 Sections that by their nature should survive termination (including Sections 5, 6, 9, 10, 11, 12, and 15) will survive.
15.GOVERNING LAW AND DISPUTE RESOLUTION
15.1 These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
15.2 Binding arbitration and class-action waiver: Except for claims that may be brought in small-claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered in Santa Clara County, California, USA, on an individual basis. You and Metano waive any right to a jury trial and to participate in a class or representative action.
15.3 The arbitration and class-waiver provisions in Section 15.2 do not apply where prohibited by applicable law. Users who are consumers in the European Union, the United Kingdom, or India may have the right to bring claims in their local courts, and mandatory local consumer protections are unaffected by these Terms.
15.4 If any provision is held unenforceable, the remaining provisions remain in effect.
16.GENERAL
16.1 These Terms are the entire agreement between you and Metano regarding the public Service and supersede prior understandings on that subject.
16.2 Metano may assign these Terms; you may not assign them without Metano's consent.
16.3 Notices to Metano: legal@metano.ai (and by post to the address in Section 1.1).
16.4 Privacy: your use of the Service is also governed by the Skill Tracer Privacy Policy.
